الاسهم الحلال لا تختلف عن غيرها من الاسهم المدرجة في سوق المال والتي تحقق نموًا وتمنح المساهمين عوائد جيدة من الاستثمار، ولكنها تختلف في التزامها ببعض الضوابط التي تتوافق مع أحكام الشريعة الإسلامية حتى تكون كافة الأموال المكتسبة منها حلال شرعًا، ومن هذه الضوابط المميزة للأسهم الحلال ما يلي:
الاسهم الأمريكية الحلال
أن تكون الشركة التابع لها الاسهم معتمدة في نشاطها على أعمال مشروعة وغير مخالفة للشريعة الإسلامية، فلا يكون مجال عمل الشركة في المحرمات الصريحة كالمتاجرة في الكحوليات أو القمار، وألا تعمل في شراء وبيع الديون، وما نحو ذلك.

ألا تتضمن المعاملات المالية للشركة الإقراض والربا، فالربا من المحرمات الصريحة في الشريعة الإسلامية، وفي حالة اضطرار الشركة للتعامل مع القروض الربوية فلابد ألا تتجاوز قيمة الدخل الناتج منها نسبة 5% من إجمالي دخل الشركة، وإن تجاوزت تلك النسبة فتصبح أسهم الشركة مختلطة وتستوجب التطهير.

لا يجوز الاستثمار في أسهم أي شركة تتجاوز ديونها نسبة ثلث الأصول المالية لها، فإن تجاوزت تلك النسبة يصبح الاستثمار فيها محرمًا حتى وإن كان نشاط الشركة مباحًا.
